An order for possession1 may be made without proof of alternative accommodation, if the court considers it reasonable to do so2, where the court is satisfied that the rent charged by the tenant3:
(1) for any sublet4 part of the dwelling house let5 on a protected tenancy6 or subject to a statutory tenancy7 is or was in excess of the maximum rent for the time being recoverable
