An application for the cancellation of the registration1 of a rent for a dwelling house may be made either:
(1) where a rent agreement2 as respects the dwelling house takes effect, or is to take effect, after the expiration of the period of two years3 beginning with the relevant date4, and the period for which the tenancy has effect cannot end, or be brought to an end5 by the landlord6, earlier than 12 months after the date of the application7, and the application is made jointly by the landlord and the tenant8 under the rent agreement9; or
