613. Application of the service charge provisions of the Landlord and Tenant Act 1985.

Statutory regulation of service charges1 payable under residential tenancies has been applied since 1972, but the current provisions are contained in the Landlord and Tenant Act 1985, which imposes statutory limitations on the amount of service charges in certain circumstances2, and confers on a tenant3 statutory rights to certain financial information from the landlord4. The Landlord and Tenant Act 19855 does not, however, apply to a service charge payable by a tenant of:


    (1)     a local authority for an area in England6;


    (2)     a National Park authority7; or


    (3)     a new town corporation8,

unless the tenancy is a long tenancy9.
