331.     Acts of organs: members of the armed forces during armed conflict.

The acts of members of the armed forces of a state will normally be attributable to it as conduct of an organ of the state1. Further, it appears that as a matter of customary international law, during an armed conflict a state party to the conflict is responsible for all acts of persons forming part of its armed forces2.
