321.     Power to search persons in police custody.

Where a person has been arrested for an offence under Part III of the Immigration Act 19711, and is in custody at a police station or in police detention2 at a place other than a police station3, an immigration officer may, at any time, search the arrested person in order to see whether he has with him anything:

  1.  

    (1)     which he might use to cause physical injury to himself or others, damage property, interfere with evidence or assist his escape4; or

  2.  

    (2)     which the officer has reasonable grounds for
