280. Power of entry.

On an application made by the Immigration Services Commissioner1, a justice of the peace may issue a warrant authorising the Commissioner to enter and search premises2. A justice of the peace may issue a warrant in respect of premises only if satisfied there are reasonable grounds for believing that:

  1.  

    (1)     a non-qualified person has provided immigration advice or immigration services3;

  2.  

    (2)     there is material4 on the premises which is likely to be of substantial value (whether by itself or together with other material) to the investigation of the offence5; and

  3.  

    (3)     either:

    1.  

      (a)     it is not practicable to communicate
