An entry clearance officer1 must issue an EEA family permit to a person who applies for one if the person is a family member of an EEA national2 and:
(1) the EEA national is residing in the United Kingdom3 in accordance with the Immigration (European Economic Area) Regulations 20164, or will be travelling to the United Kingdom within six months of the date of the application and will be an EEA national residing in the United Kingdom in accordance with the Regulations on arrival in the United Kingdom5; and
(2) the family member will be accompanying the EEA national
