An application for leave to remain either as a partner1 or a parent2 by a person who cannot meet all the eligibility requirements but meets specified eligibility requirements3 may still be granted if:
(1) the person has a genuine and subsisting parental relationship with a child4 who:
(a) is under the age of 18 years or was under the age of 18 years when the person was first granted leave on the basis that this provision applied5;
(b) is in the United Kingdom6; and
(c) is a British citizen or has lived in the United Kingdom continuously for at
