317.     Entry and search of premises for documents.

Where a person is arrested1 or detained by an immigration officer following arrest2, an immigration officer may enter and search any premises occupied or controlled by the arrested person or in which that person was when he was arrested, or immediately before he was arrested, for relevant documents3. This power may be exercised:

  1.  

    (1)     only if the officer has reasonable grounds for believing that there are relevant documents on the premises4;

  2.  

    (2)     only to the extent that it is reasonably required for the purpose of discovering relevant documents5; and
