As from a day to be appointed1 a person commits an offence if he:
(1) drives a motor vehicle on a road2 or other public place at a time when the person is not lawfully resident3 in the United Kingdom4; and
(2) at that time he knows or has reasonable cause to believe that he is not lawfully resident in the United Kingdom5.
A penalty is prescribed by statute for this offence6.
