If a person has been arrested for an offence of assisting unlawful immigration to a member state1, or helping an asylum seeker to enter the United Kingdom2, or assisting entry in breach of a deportation or exclusion order3, a senior officer4 or a constable may detain a relevant ship, aircraft or vehicle5:
(1) until a decision is taken as to whether or not to charge the arrested person with that offence6; or
(2) if the arrested person has been charged:
(a) until he is acquitted, the charge against him is dismissed or the proceedings are discontinued7; or
