394. Circumstances in which humanitarian protection will not be granted.

A person is excluded from a grant of humanitarian protection1 where the Secretary of State2 is satisfied that:

  1.  

    (1)     there are serious reasons for considering that he has committed a crime against peace, a war crime, a crime against humanity, or any other serious crime or instigated or otherwise participated in such crimes3;

  2.  

    (2)     there are serious reasons for considering that he is guilty of acts contrary to the purposes and principles of the United Nations or has committed, prepared or instigated such acts or encouraged or induced others to commit, prepare or instigate such acts4;
