339. Bail procedure before the Special Immigration Appeals Commission.

Where a person is detained under the Immigration Act 1971 or the Nationality, Immigration and Asylum Act 2002 the statutory provisions1 in relation to bail are modified2, if3:


    (1)     the Secretary of State4 certifies that his detention is necessary in the interests of national security5;


    (2)     he is detained following a decision to refuse him leave to enter the United Kingdom6 on the ground that his exclusion is in the interests of national security7; or
