The Secretary of State1 must issue a code of practice specifying what an employer should or should not do in order to ensure that, while avoiding liability to a statutory penalty2 and while avoiding the commission of an offence3, he also avoids contravening the Equality Act 2010, so far as relating to race or the Race Relations (Northern Ireland) Order 19974.
