The criteria to be applied where a foreign criminal liable to deportation1 claims that his deportation would be contrary to the United Kingdom's2 obligations under art 8 of the European Convention on Human Rights3 or applies for a deportation order made against him to be revoked on that basis set out in the Immigration Rules4 are also encompassed in statute5. In considering the requirements of the 'public interest question'6 in an art 8 appeal, a court or tribunal must have regard to certain general considerations applying in all art 8 appeals and certain additional considerations in art 8 appeals
