As from a day to be appointed1, for the purposes of the provisions relating to asylum support2, a person having made further qualifying submissions is one of the criteria that defines a person as an asylum seeker3.
A person makes 'further qualifying submissions' if:
(1) he makes submissions to the Secretary of State4 that his removal from the United Kingdom5 would breach the United Kingdom's obligations under the Refugee Convention6 or the United Kingdom's obligations in relation to a grant of humanitarian protection7; and
(2) the submissions fall to be considered by the Secretary of State as a fresh protection
