Every employer1 must ensure:
(1) that a power press2 is not put into service for the first time after installation, or after assembly at a new site or in a new location unless:
(a) it has been thoroughly examined3 to ensure that it has been installed correctly and would be safe to operate4; and
(b) any defect5 has been remedied6;
(2) that a guard, other than that part of a closed tool which acts as a fixed guard, or protection device is not put into service for the first time on a power press unless:
