Subject to certain exceptions1, it is the duty of each person who has, to any extent, control of premises2 to ensure that no notifiable device is situated on those premises unless the prescribed information3 has been notified in writing, on a form approved for the time being for these purposes by the Health and Safety Executive4, to the local authority5 in whose area the premises are situated6. For these purposes, a 'notifiable device' means a cooling tower7 or an evaporative condenser8 except: (1) where it contains no water that is exposed to air; and (2) where its water supply
