An economic operator1 ('A') who would, but for this provision, be considered an importer2 or distributor3, is to be considered a manufacturer4 for the purposes of the Equipment and Protective Systems Intended for Use in Potentially Explosive Atmospheres Regulations 20165 and is subject to the obligations of the manufacturer under Part 2 of those regulations6, where A: (1) places a product7 on the market8 under A's own name or trademark; or (2) modifies a product already placed on the market in such a way that it may affect whether the product is in conformity with Part 29.
