A contravention1, in relation to a mine2, of:
(1) any provision of the Mines and Quarries Acts 1954 and 19693, or of orders or regulations made thereunder, which does not provide expressly that a person is guilty of an offence; or
(2) a direction, prohibition, restriction or requirement given or imposed by a notice served under or by virtue of those Acts by an inspector4; or
(3) a condition attached to an exemption, consent, approval or authority granted or given under or by virtue of those Acts by the Health and Safety Executive5 or an inspector; or
