716.     Duty to control risk and internal emergency response duties in relation to external waters.

Where an activity carried out by a duty holder1 significantly increases the risk of a major accident2 the duty holder must take suitable measures to ensure that the risk is reduced as low as is reasonably practicable, including, where necessary, suspending the relevant activity until the risk is adequately controlled3. The duty holder must notify the Health and Safety Executive and Secretary of State4 where it has taken such measures immediately after, and in any event no later than 24 hours after,
