The Control of Major Accident Hazards Regulations 20151, which implement the EU Directive on the control of major accident hazards involving dangerous substances (the 'Seveso III Directive')2, apply to an establishment3 which is either a lower tier establishment4 or an upper tier establishment5 where a dangerous substance6 is present7 in a quantity equal to or exceeding the specified quantity8. The regulations do not, however, apply to any of the following:
(1) an establishment which is under the control of: (a) the Secretary of State for the purposes of the Ministry of Defence; (b) a headquarters or organisation designated for
