Where land is held on a trust of land any conveyance or transfer must be made by the trustees, being at least two individuals or a trust corporation, in order to overreach the equitable interests of the beneficiaries1. Co-owners hold land on a trust of land2.
Where there is a trust of land, the trustees have a duty to consult with, and, so far as is consistent with the general interests of the trust, give effect to the wishes of the adult competent beneficiaries who are beneficially entitled to an interest in possession of the land, when exercising their functions
