323. Title to be deduced on grant of a sub-lease.

Where the contract is for the grant of a sub-lease out of an unregistered reversionary title, unless the parties are contracting to grant a lease which will trigger first registration statutory provisions prescribe1 that rights of a sub-tenant in relation to deduction of title are limited to calling for the head-lease out of which his sub-lease is to be derived2. In the absence of a contractual condition to the contrary he is not entitled to call for production of the freehold title
