Where the survivor held the property as a beneficial tenant in common1, another trustee must be appointed in order to transfer the legal estate in the land2. This appointment can be made either by separate deed of appointment or by including the appointment in the purchase deed. In either case the purchase deed will have to be redrafted to reflect the change in parties. The seller's solicitor may act as the second trustee provided that there is no potential conflict of interests between the survivor and other beneficiaries (if any)
