The written contract must be signed by or on behalf of each party to the contract1. The contract may be signed by a person who is an agent of both parties2, for example a contract signed on behalf of both parties by an auctioneer immediately after a sale by auction3. The agent must be a third person; a contract cannot be signed by one of the parties to the contract as agent for the other so as to satisfy the statutory requirement4, although it may be signed on behalf of one party by a person who is already acting
