The Trusts of Land and Appointment of Trustees Act 1996 prohibits the creation of new strict settlements (except in limited circumstances)1. The following will generally be relevant only to settlements which were in existence on 1 January 19972.
In the case of registered land the tenant for life (or, if none, the statutory owners) will be registered as proprietor of the land and an appropriate restriction entered on the register. Provided that the buyer complies with the terms of the restriction he will take a good title3.
