240. Probate and administration.

If a grant of representation is relevant to the title and the seller cannot produce the original or a marked copy of the grant on completion, the buyer should consider making a pre-completion search at the Probate Registry1 to ensure that the grant has not been revoked or, in the case of a limited grant, that it has not expired2.

The protection given to a buyer by the Administration of Estates Act 1925, that the payment of money to a personal representative in good faith acts as a good discharge to the payer, only operates where the grant is valid
