Where there are joint buyers, the legal estate in the land will be held on a trust of land but the buyers have the choice whether to hold the beneficial interest as joint tenants1 or as tenants in common2. The legal joint tenancy is not severable and there must be a minimum of two trustees (and maximum of four) in order to deal with the legal estate
