301. Duty to apply for registration.

Where registration is compulsory1, the transferee, lessee or borrower is under a duty to apply for first registration2.

In the case of a mortgage, the application is usually made by the mortgagee, who may make the application in the name of the borrower whether or not the latter consents3.

The application for first registration must be made within two months of the act which triggers compulsory registration, but may be extended by the registrar
