73. Discovering easements.

To discover easements the solicitor needs to:


    (1)     inspect the official copy of the register or the title deeds;


    (2)     if the title is unregistered, carry out a search at the Land Charges Department1 to check whether any D(iii) (equitable easement) land charges are registered2;


    (3)     if acting for the seller, make enquiries of the client as to the rights his neighbours and others enjoy over the property being sold and the rights he enjoys over adjoining property;
