206. Death of co-owner.

Although property owned by beneficial co-owners is held on trust and all the trustees must join in any conveyance of the legal estate1 the death of one trustee between exchange of contracts and completion does not affect the validity of the contract2.

If, following the death, there are still at least two trustees of the legal estate, the transaction can proceed to completion without delay.
