A document containing an exclusion clause which is signed by the passenger or consignor of goods will be incorporated into the contract of carriage provided that it was intended to be a contractual document1. Such terms will, in the absence of fraud or misrepresentation on the part of the carrier or his employee or agent2, be binding on the passenger or consignor whether he knew of the terms or not
