Any right to claim arising from a contract of carriage governed by the CMR Convention1 is barred if proceedings are not commenced within a year; if, however, the cause arises from wilful misconduct or from default which, in accordance with the law of the court or tribunal seised of the case, is considered equivalent to wilful misconduct2, the period of limitation is three years3.
