120. Limitation of actions.

The right to damages is extinguished1 if either a claim or arbitral proceedings are not brought within two years2, reckoned from the date of arrival at the destination, or from the date on which the aircraft ought to have arrived or on which the carriage stopped3. The same limitation applies to any claim or arbitral proceeding against or involving the servant or agent of a carrier4 which arises out of damage to which the Montreal Convention relates, provided the servant or agent was acting within the scope of his employment
