233. Exception in charterparty covering cause of delay or failure.

Where the charterparty contains an exception which covers a cause of delay in loading or failure to load, as the case may be, the charterer is excused1. Unless the contrary intention is clearly expressed, such exceptions are to be understood as applying only to the actual loading2. They do not, therefore, protect the charterer against a failure to provide a cargo, which is an absolute and non-delegable duty3. Neither do such exceptions protect the charterer against the consequences of delay4
