The liabilities of a shipper or carrier as an original party to a contract of carriage are not affected by the Carriage of Goods by Sea Act 19921.
Where any person entitled2 to sue takes or demands delivery or otherwise makes a claim against the carrier, he becomes subject to any3 contractual liabilities as if he had been a party to the contract of carriage
