414. Commercial nature of fob contracts.

Where goods are sold fob (free on board) the duty of the seller is to deliver the goods on board ship at the contractually appointed port1 at his own expense for carriage to the buyer. The terms of the contract may specify the ship or line on which the goods are to be loaded or entitle the buyer to give subsequent instructions to the seller in regard to shipment2, the time for giving any such instructions being of the essence3.
