The Montreal Convention1 does not apply to carriage by aircraft performed by a person or body which is not an air transport undertaking2. The Convention also does not apply to gratuitous carriage by the Crown where that carriage is of members of Her Majesty's naval, military or air forces undertaken during a time of actual or imminent hostilities or of severe international tension or of great national emergency3.
