If an air carrier has a valid operating licence granted by an EU member state1, its liability in respect of passengers and their baggage is governed by all provisions of the Montreal Convention2 relevant to such liability3. The EU has ratified the Convention in its capacity as a Regional Economic Integration Organisation4 and has also made specific provision for implementing the Convention within the EU as a whole and within the territories of each member state5, all of which have also ratified the Convention as individual parties6
