The carrier1 and the ship2 are in any event3 discharged from all liability whatsoever4 in respect of the goods5, unless suit6 is brought within one year of their delivery7, or of the date when the goods should have been delivered8. The suit may be brought in any competent jurisdiction, not necessarily in the jurisdiction where the matter is ultimately decided9; and the suit must be brought in the name of a party who has title to sue10. The one-year period may, however, be extended if the parties so agree after the cause of action has arisen11.
