Where plans1 of a building2 or of an extension of a building are, in accordance with building regulations3, deposited with a local authority4, the local authority, or on appeal a magistrates' court5, may require a proposed drain6 to connect with a sewer7 where8:
(1) that sewer is within 100 feet of the site of the building or, in the case of an extension, the site either of the extension or of the original building, and is at a level that makes it reasonably practicable to construct9 a drain to communicate with it, and, if it is not a public
