An unregistered person1 practising or carrying on business under any name, style or title containing the word 'architect' is liable, on summary conviction, to a fine2.
A person will not, however, be guilty of an offence by reason of the contravention on any particular date of the restrictions on the use of the title 'architect' if the contravention is occasioned by:
(1) the fact that an application on his part for registration under the Architects Act 1997 had not been granted and notice of the decision not to grant the application had not been duly served under that Act before
