A claim may be made against the employer for injury or damage arising by reason of the negligence or default of the contractor in carrying out the works1. Consequently, standard form contracts frequently contain clauses requiring the contractor to indemnify the employer against such claims as well as to insure against them2. Sometimes the employer will give a cross-indemnity to the contractor where the latter is liable by reason of the default of the employer.
