Channel 41 is licensed under Part I of the Broadcasting Act 1990 and Part 3 of the Communications Act 20032.
Its licence (a 'replacement licence' under the Communications Act 2003) may be renewed, on one or more occasions, for such period as Ofcom may think fit in relation to the occasion in question3.
The conditions of such a licence must include:
(1) the conditions that Ofcom considers appropriate for the purpose of performing its statutory duty4 to secure that the holder of the licence at all times holds his licence on the conditions which are for the time being included in
