312H. Suspension or restriction of video-sharing platform services for non-compliance with duties

The appropriate regulatory authority1 must serve a notice on a provider of a video-sharing platform service2 if it is satisfied:


    (1)     that the provider has contravened of the statutory requirement to give advance notification of providing such a service3, is in contravention of its general statutory duties4, is in contravention of certain duties relating to commercial communications5, has failed to take a measure which the authority considers to be appropriate in relation to that service6, or has failed to implement such a measure7;


    (2)     that the imposition of one or more financial penalties or enforcement notifications8 has not resulted
