Ofcom1 may give a notice in writing2 to a satellite uplinker3:
(1) in relation to a relevant regulated television service4, if Ofcom is satisfied that the service is provided either:
(a) in contravention of a Broadcasting Act licence for television services5; or
(b) otherwise than pursuant to such a licence6;
(2) in relation to an on-demand programme service7, if Ofcom is satisfied that the service is provided either:
(a) in contravention of a requirement of Part 4A8 of the Communications Act 2003; or
(b) otherwise than pursuant to a notification to provide an on-demand programme service that is required
