369. Restrictions on and disqualification for the holding of licences.

Ofcom1 must do all it can to secure:

  1.  

    (1)     that a person2 does not become or remain the holder of a licence3 if he is a disqualified person in relation to that licence4;

  2.  

    (2)     that a person does not become the holder of a licence if requirements imposed by or under the Communications Act 20035 would be contravened were he to do so6; and

  3.  

    (3)     that those requirements are not contravened in the case of a person who already holds a licence7.

Ofcom may accordingly:

  1.  

    (a)     require any applicant for a licence to provide it with such information as it
