351.     Product placement.

'Product placement', in relation to a programme1 included in an on-demand programme service2, means the inclusion in the programme of, or of a reference to, a product, service or trade mark3, where the inclusion:

  1.  

    (1)     is for a commercial purpose4;

  2.  

    (2)     is in return for the making of any payment, or the giving of other valuable consideration, to any relevant provider or any connected person5; and

  3.  

    (3)     is not prop placement6.

Product placement is prohibited in children's programmes7, or news and current affairs programmes, or consumer affairs programmes, or religious programmes, included in on-demand programme
