65. Procedure for prosecutions of wireless telegraphy offences.

The following provisions1 apply to proceedings against a person2 ('the defendant') for an offence3 consisting in the contravention of: (1) the terms, provisions or limitations of a wireless telegraphy licence4; or (2) the terms, provisions or limitations of an exemption5 from a licensing requirement6. Such proceedings are not to be brought unless, before they are brought, Ofcom7 has: (a) given the defendant a notification8 in respect of the contravention to which the proceedings relate; and (b) considered any representations about the matters notified which were made by the defendant within the period allowed
